Open Arts Alliance Minor Participant Waiver, Release, Indemnification of All Claims & Covenant Not to Sue

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT.

Read this document carefully and in entirety. By signing this agreement, you give up your right and the named minor’s right to bring a court action to recover compensation or obtain any other remedy for any personal injury or illness however caused arising out of the named minor’s participation in the Open Arts Alliance's program, now or any time in the future.

Coronavirus /COVID-19 Warning & Disclaimer

Coronavirus, COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in Open Arts Alliance's programs could increase the risk of contracting COVID-19. Open Arts Alliance in no way warrants that COVID-19 infection will not occur through participation in the Open Arts Alliance program or accessing the used facilities.

Waiver, Release, Indemnification & Covenant Not to Sue

In consideration of my child’s participation in Open Arts Alliance's program I, the parent/guardian of the minor named above, agree to release and on behalf of myself and the minor named above, my heirs, representatives, executors, administrators, and assigns, HEREBY DO RELEASE Open Arts Alliance, its officers, directors, employees, volunteers, agents, representatives and insurers (“Releasees”) from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I, the named minor, my heirs, representatives, executors, administrators and assigns may have, now or in the future, against Open Arts Alliance on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the participation in Open Arts Alliance's program however the injury or damage occurs, including, but not limited to the negligence of Releasees.

In consideration of the named minor’s participation in Open Arts Alliance, I, the undersigned parent/guardian of the named minor, agree to INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to the named minor’s participation.

I hereby certify on behalf of myself and the named minor that I have full knowledge of the nature and extent of the risks inherent in Open Arts Alliance's facilities and program participation and that I, on behalf of myself and the named minor, am voluntarily assuming said risks. I understand that I and the named minor will be solely responsible for any loss or damage, including personal injury, property damage, or death, the named minor sustains while participating in Open Arts Alliance and that by signing this agreement I, on behalf of myself and the named minor, HEREBY RELEASE Releasees of all liability for such loss, damage, or death. I further certify that the named minor is in good health and has no conditions or impairments which would preclude his/her safe participation in said program.

I further certify that I am of lawful age (18 years or older) and otherwise legally competent to sign this agreement, and that I have legal capacity to act as the parent/guardian of the named minor. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement, after having carefully read it, of my own free will.

My child and I understand that joining an Open Arts Alliance’s production is a serious commitment of time and energy.

By accepting my role in this production, I hereby agree to:

*PUNCTUALLY attend all rehearsals, meetings, and scheduled events that require my participation.

*Be properly prepared for all rehearsals, including but not limited to, having memorized my lines, practiced my music and movement, and completed all work assigned to me.

*Work and behave in a professional manner during all rehearsals. I will be respectful, considerate, constructive of others, and not distract my peers.

*Check www.OpenArtsAlliance.com daily for updates on casting, scheduling, rehearsal materials, costumes or other information.

*Assist as crew for publicity, costuming, props, set construction, and/or any other responsibilities needed.

If, for whatever reason, I cannot attend a rehearsal due to an unavoidable prior commitment, I will email Open Arts Alliance at info@openartsalliance.com

My child and I understand that all casting choices are final, and use of inappropriate behavior or language may result in dismissal from production. On all such matters, decision by Open Arts Alliance administration is final.

Parent/guardian/student grants to Open Arts Alliance the right to use his/her name, biography, photographs, likeness or recorded image and voice for promotional purposes by any means or medium.

I understand that if I cannot live up to my responsibility, Open Arts Alliance may replace me. I agree with all of the statements in this contract, and promise to adhere to the responsibilities listed.

I have read the frequently asked questions related to this production on the Open Arts Alliance website and understand the full extent of this commitment.

I have read the Policies and Procedures.

Camaraderie and cooperation is expected of students at all times. As a guardian, I understand that I play an important role in teaching my child in exemplifying appropriate behavior. I agree to model a positive attitude during the entire rehearsal process, regardless of the outcome of the audition. I agree to encourage my child to display the same perspective. Should the administration of Open Arts Alliance feel that my child or I are using bullying language, tactics, threats or agressions at any level, we understand that we may be removed immediately from this and all future productions and that the sole determination of this lies with the administration of Open Arts Alliance. I have thoroughly read this contract and agree to the commitment it contains. I agree to the above terms and conditions.
